Volunteer Vacation and Good Card Contest Official Rules

  1. Contest Description. The “Change Begins With Me Contest” (the “Contest”) is open to any person who meets the eligibility criteria set forth below and submits an entry in accordance with these Official Rules (each such person, an “Entrant”). The Contest will have one Grand-Prize Winner and nine Runners-Up (each, a “Winner”).
  2. The Sponsor. This Contest is sponsored by The Case Foundation, 1717 Rhode Island Avenue, N.W., 7th Floor, Washington, D.C. 20036 (the “Sponsor”).
  3. Entry Deadlines. The entry period for the Contest commences at or around 3:01 p.m. EST on January 12, 2009 and continues through 3:00 p.m. EST on February 12, 2009 (the “Contest Entry Period”). All confirmed submissions by 9am EST on Mondays will be eligible for that week’s Good Card drawing. All submissions must be confirmed by 5pm EST on February 12, 2009 for the Grand Prize drawing. 
  4. Entrant Eligibility. No purchase, contribution, or payment of any kind is necessary to enter or win the Contest. Void wherever restricted or prohibited by law. Only one entry per person. Open to legal residents of the United States, including the District of Columbia and Puerto Rico, aged 14 years and older at time of entry. Any Entrant who is a minor in his or her jurisdiction of primary residence must obtain the permission of his or her parent or legal guardian to participate. Directors, officers, and employees of the Sponsor, or of any affiliated organization, and the members of the immediate families of each, are not eligible to participate or win a prize. By participating in the Contest, each Entrant agrees to be bound by these Official Rules and by the decisions of the Sponsor, which are final in all matters relating to the Contest. Grand Prize Winner of the Case Foundation Inauguration Trip Contest is not eligible to participate or win. Runner up winners of the Case Foundation Inauguration Trip Contest are not eligible to participate or win the $250 Weekly Good Card prize. $250 Weekly Good Card winners are not eligible to win multiple Good Cards. All confirmed submitted commitments, excluding Grand Prize Winner of the Inauguration Trip, are eligible to win the Volunteer Vacation.
  5. How to Enter the Contest. Each potential Entrant must:
    1. visit http://www.CaseFoundation.org/Change (the “Contest Web Site”);
    2. completely fill out all required data fields on the registration form;
    3. in 250 characters or fewer, complete the phrase “Change begins with me ... I commit to: ______________” (each such answer, a “Submission”); and
    4. respond as instructed to a confirmation email. Each complete and confirmed registration, together with a Submission, is considered an “Entry” and each Entry that meets the requirements of these Official Rules is referred to herein as an “Eligible Entry.”
  6. Submission Restrictions. Submissions will be deemed ineligible and will not be accepted if they include any of the following:
    1. any content that endorses or condones illegal drug use or alcohol abuse;
    2. any profanity;
    3. any commercial endorsements;
    4. any derogatory characterization of any ethnic, racial, sexual, or religious group(s);
    5. any unauthorized use of any intellectual property that is protected by trademark, copyright, or other intellectual-property laws from any source; or
    6. any other language or other content deemed inappropriate by the Sponsor.
  7. Rights to Submissions. 
    1. Each Entrant hereby agrees to enter his or her Submission under the following terms and conditions:
      1. that the Entrant’s Submission and all rights thereto become the sole property of the Sponsor and will not be returned;
      2. that the Entrant’s Submission is free from any lien or claim by anyone, including but not limited to any union, guild, or performance-rights society;
      3. each Entrant has obtained all rights, permissions, and licenses necessary for the Sponsor to use the Entrant’s Submission for any purpose;
      4. that Entrant has waived any moral or similar rights to the Submission;
      5. that no Submission by Entrant or any part thereof infringes any trademark, copyright, or other intellectual-property right, or otherwise violates anyone’s right of privacy or publicity; and
      6. each Entrant shall indemnify and hold harmless the Sponsor and its directors, officers, employees, and agents from any claims, suits, losses, damages, and expenses (including reasonable attorneys’ fees) that arise from any breach of the preceding conditions. Each Entrant agrees to the foregoing and in addition agrees to obtain or execute and deliver, upon request of the Sponsor, any documentation and releases necessary to prove his or her unrestricted ownership in all materials contained in his or her Submission and his or her right to use such materials without limitation for any purpose and to transfer such rights to the Sponsor.
    2. Each Entrant further agrees:
      1. that his or her Submission may be used by the Sponsor in whole or in part for any purpose whatsoever without any compensation; and
      2. that the transfer to the Sponsor of all rights in the Submission includes a grant to the Sponsor of the exclusive, irrevocable right and license to exhibit, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, edit, broadcast, rebroadcast, transmit, record, publicly perform, create derivative works of, distribute and synchronize in timed relation to visual elements, and otherwise use the materials contained in his or her Submission and/or any portions or excerpts thereof, in any manner, an unlimited number of times, in any and all media, now known or hereafter devised, throughout the world, in perpetuity. Each Entrant also agrees to confirm this agreement in writing upon request by the Sponsor.
    3. Each Entrant also acknowledges and agrees that the Sponsor is under no obligation to use any Submission by Entrant or any materials contained in any such Submission for any purpose at any time
  8. Disclaimers. The Sponsor assumes no responsibility for incorrect or inaccurate information about an Entry, whether caused by any of the equipment or programming associated with or utilized in the Contest or by any human error that may occur in the processing of Entries to the Contest. The Sponsor is not responsible for any failure, problem, or technical malfunction of any telephone or other network or lines, computer online systems, servers or providers, computer equipment, software, email, web browser on account of technical problems, traffic congestion or the Internet or at any web site, any combination thereof, or otherwise, including without limitation injury or damage to any Entrant or to any other person’s computer related to or resulting from participating in or uploading materials for the Contest. If, for any reason, the Contest is not capable of running as planned, including problems with any computer system caused by any computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest or for any reason the Sponsor deems it necessary, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, delay, or suspend the Contest.
  9. Determination of Winners. The Sponsor, at its address listed in these Official Rules, will select ten Winners at random from among all Eligible Entries received for the Contest, including one Grand-Prize Winner and nine Runners-Up. Each Entrant’s chance of winning depends upon the number of Eligible Entries received.
  10. Prizes. 
    1. The Grand-Prize Winner will receive:
      1. a 2009 volunteer vacation in the continental United States at a location to be determined by the Case Foundation;
      2. Each Weekly winner will receive a $250 Good Card. The Good Card can only be redeemd at Network For Good. Good Cards are not redeemable for cash and cannot be returned for a cash refund.
      3. The Sponsor and its donors are the sole source of the funds used to purchase the prizes. The Sponsor reserves the right in its sole discretion:
        1. to substitute for any prize a prize of comparable value for any reason that it deems necessary; and
        2. to delay the announcement of any of the Winners.
      4. In the event of a dispute over who submitted a winning Entry, the owner of the email account listed in the winning Entry will be declared the Winner. 
    2. Contacting the Winners.
      1. The Grand Prize Winner will be notified by email on or around 6:00 p.m. (EST) on February 12, 2009. If any Winner is unreachable, or if he or she does not comply with these Official Rules, including completion and return to the Sponsor of all required documentation by 5 p.m. (EST) on February 17, 2009, an alternate Winner may be selected at random from all remaining Eligible Entries.
      2. b. Each Weekly Winner will receive a $250 Good Card. The Good Card can only be redeemed at Network For Good. Good Cards are not redeemable for cash and cannot be returned for a cash refund. The Sponsor will make a minimum of one attempt to contact the Winners.
    3. Grand Prize Winners’ Documentation and Duties. 
      1. Each Winner (or the parent or legal guardian of any Winner who is a minor in his or her jurisdiction of primary residence) may be required to sign:
        1. an affidavit of eligibility and liability release releasing the Sponsor and its directors, officers, employees, and agents from any and all liability, claims, demands, and causes of action for taxes, personal injury or damage, theft, loss, or any other harm suffered in connection with the Contest;
        2. except where prohibited by law, a promotional release granting the right to use his or her name and likeness for advertising and publicity purposes without additional compensation;
        3. any relevant tax documentation; and
        4. at the Sponsor’s request, any additional legal documentation to confirm the Sponsor’s rights in and to each Winner’s winning Submission and the Winner’s obligations under these Official Rules, including, in the case of the Grand-Prize Winner, a release, including the social security numbers of the Grand-Prize Winner and his or her guest, permitting the Sponsor to conduct a background investigation of the Winner and his or her guest for the 2009 Presidential Inauguration.
      2. Entry into the Contest constitutes each Entrant’s agreement to sign such documents. A Winner’s failure to sign and deliver any of such documents when requested may result in disqualification and selection of an alternate Winner. Any other violation of these Official Rules by any Winner may result, in the Sponsor’s sole discretion, in such Winner’s disqualification as a Winner of the Contest and the termination of all privileges as a Winner. Each Winner is solely responsible for any federal, state, or local taxes due on any prizes awarded by the Sponsor.
      3. The Grand-Prize Winner agrees to take video footage on the prize Flip Video Cam (the “Grand-Prize Video”) and to grant the Sponsor an irrevocable, global, perpetual, non-exclusive, royalty-free license to use the Grand-Prize Video in whole or in part for any purpose whatsoever, including the right and license to exhibit, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, edit, broadcast, rebroadcast, transmit, record, publicly perform, create derivative works of, distribute and synchronize in timed relation to visual elements, and otherwise use the materials contained in the Grand-Prize Video and/or any portions or excerpts thereof, in any manner, an unlimited number of times, in any and all media, now known or hereafter devised. 
    4. The Sponsor’s Rule Decisions and Discretion. All interpretations of these Official Rules and decisions of the Sponsor in all matters related to the Contest are final. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds or believes:
      1. to be tampering with the entry process or the operation of the Contest or the Contest Web Site;
      2. to be acting in violation of these Official Rules; or
      3. to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Any attempt by any person to deliberately damage the Contest Web Site or any related web sites or undermine the legitimate operation of the Contest may be pursued to the full extent of the criminal and civil laws, and the Sponsor reserves the right to seek damages from any such person.
    5. Jurisdiction and Governing Law. The local and federal courts of the District of Columbia have sole jurisdiction of any controversies regarding the Contest, and the laws of the Commonwealth of Virginia govern the Contest. Each Entrant waives any and all objections to jurisdiction and venue in those courts and hereby submits to the jurisdiction of those courts.
    6. Requests for Rules or List of Winners. For the names of the Winners and/or a copy of these Official Rules, send a self-addressed, stamped envelope to:

      All requests must be received by March 31, 2009. Please note on the front left-hand corner of the outer envelope whether you are requesting “Rules” or the names of the “Winners” or both. Vermont residents may omit return postage if requesting a set of Official Rules.
